End User License Agreement (EULA)

This End User License Agreement (“Agreement”) is a legal agreement between you (“User,” “you,” or “your”) and Aardvark Partners (“Company,” “we,” “our,” or “us”) governing your use of the Kiwi - Owner Dashboard web application (“Web App”).

By accessing or using the Web App, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not use the Web App.

1. License Grant

The Company grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Web App for its intended purposes, subject to the terms and conditions outlined in this Agreement.

2. Restrictions

You agree not to:

• Copy, modify, or create derivative works of the Web App.
• Reverse engineer, decompile, or disassemble any part of the Web App.
• Sell, rent, lease, sublicense, distribute, or transfer the Web App to any third party.
• Use the Web App for any unlawful purpose or in violation of any applicable law.
• Interfere with or disrupt the functionality of the Web App.

3. Ownership

The Web App, including its content, features, and functionalities, is owned by the Company and its licensors. All rights not expressly granted under this Agreement are reserved.

4. User Responsibilities

You are responsible for:

• Maintaining the confidentiality of any login credentials associated with the Web App.
• Ensuring that all information provided to the Web App is accurate and up-to-date.
• Complying with all applicable laws and regulations in connection with your use of the Web App.

5. Privacy

Your use of the Web App is also governed by our Privacy Policy. By using the Web App, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.

6. Third-Party Services

The Web App may integrate or interact with third-party services. The Company is not responsible for the availability or performance of these third-party services, nor does it endorse them.

7. Disclaimers

The Web App is provided “as is” and “as available.” The Company makes no warranties, express or implied, regarding the Web App, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

8. Limitation of Liability

To the fullest extent permitted by law:

• The Company shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Web App.
• The Company's total liability under this Agreement shall not exceed the amount you paid to access the Web App (if any).

9. Termination

This Agreement is effective until terminated. The Company may suspend or terminate your access to the Web App at any time, with or without notice, for any reason, including your violation of this Agreement.

10. Modifications

The Company reserves the right to modify this Agreement at any time. Any changes will be posted on the Web App, and your continued use of the Web App after such changes will constitute your acceptance of the updated Agreement.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Washington.

13. Entire Agreement

This Agreement constitutes the entire agreement between you and the Company regarding the Web App and supersedes any prior agreements.

By using the Kiwi - Owner Dashboard, you acknowledge that you have read, understood, and agree to be bound by this End User License Agreement.
